Pursuant to California Government Code section 11346.45, the California Native American Heritage Commission (NAHC) will hold a pre-notice public hearing/workshop and a separate tribal consultation to gather information and input concerning the adoption of proposed regulations to be added to Title 14 of the California Code of Regulations regarding the charging of fees for searches of the NAHC’s Sacred Lands Inventory (described in Public Resources Code sections 5097.94(a) and 5097.96) and of its AB 52 and SB 18 Tribal Consultation Lists (described in Public Resources Code section 21073) pursuant to its authority provided under Public Resources Code section 5097.94 (o). The tribal consultation is limited to tribal chairpersons, tribal councilmembers, or designees with written authorization to speak on behalf of their tribes.
The purpose of charging fees for searches of the NAHC’s Sacred Lands Inventory and for searches of its AB 52 and SB 18 Tribal Consultation Lists is to cover the costs of providing these services. There are no draft regulations at this point. The purpose of the public hearing/workshop and the tribal consultation is to receive public comment and input before drafting the regulations.
The NAHC will hold tribal consultation with individual tribes upon request before and during the rulemaking process.
